iuspirit by Avadanei Petrica Iulian e c. SAS, hereinafter referred to as “iuspirit”, with registered office at Via Cesare Battisti 37/B, Mirano (VE), and VAT number 04635960273, is the owner of the website www.iuspirit.com.

  1. ACCEPTANCE OF THE GENERAL TERMS OF SALE

1.1 – The contract between iuspirit and the Customer is considered concluded with the acceptance, either partial or full, of the order by iuspirit. Unless otherwise communicated, such acceptance is considered implicit. By placing an order using one of the available methods, the Customer declares they have read and accepted all the information provided during the purchase process and fully accept the general terms and payment conditions outlined below.

1.2 – If the Customer is a private consumer (i.e., an individual purchasing goods for purposes not related to their professional activity), once the online purchase procedure is complete, they must print or save an electronic copy and retain these general terms of sale in compliance with Articles 50 and following of Legislative Decree 206/05.

1.3 – Failure to accept an order, in whole or in part, and improper use of the purchased products excludes any right of the Customer to claim damages or compensation, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property.

1.4 – Due to unavailability of the ordered materials or other reasons even after payment, iuspirit reserves the right to cancel an order and refund the amount paid by the buyer. No compensation can be claimed for the unavailability of products; the buyer will only be entitled to a full refund or may choose an equivalent amount for alternative products.

1.5 – iuspirit holds stock of all products marked as available for immediate dispatch. Other products are ordered from suppliers upon order confirmation. An estimated dispatch date is provided, but this is purely indicative and does not bind iuspirit to the Customer or third parties. iuspirit is not responsible for delays due to supplier unavailability or delays not directly attributable to iuspirit. Upon request, iuspirit will promptly refund the payment and cancel the order if it cannot be fulfilled due to force majeure. For bank transfer payments, the Customer agrees to provide the necessary bank details for the refund process.

1.6 – iuspirit is not liable for damages caused during transport by the carrier, who is solely responsible for the transported goods. Any request for replacement, return, or cancellation due to transport-related damages can only be made if damages are reported to the courier at delivery with the “signed with reserve” notation. Product replacement will only occur after proper verification of the returned defective item, within 14 working days (subject to availability).

  1. PURCHASE METHODS

2.1 – The Customer may only purchase products listed in the online catalog at www.iuspirit.com at the time of order, as described in the relevant technical and informational sheets, subject to manufacturer improvements. The product images may differ in some details such as color, size, and included accessories. All supporting information (Glossary, Guides, etc.) is considered general information and may not reflect the exact characteristics of each product. Prices indicated include VAT at the prevailing rate in Italy.

2.2 – Order receipt is confirmed by iuspirit via email to the address provided by the Customer. The confirmation will include the Date and Time of the order and an Order Number, to be referenced in any future communication with iuspirit. The email will contain the Customer’s entered details, and the Customer is responsible for verifying the accuracy of this information and promptly reporting any corrections.

2.3 – In case of non-acceptance of the order, iuspirit will promptly notify the Customer.

  1. PAYMENT METHODS

3.1 – For purchases made by credit card (credit card, debit card, prepaid card), the charge will be made at the time of order confirmation.

3.2 – iuspirit reserves the right to request additional information from the Customer (e.g., landline number) or copies of documents proving ownership of the card used. In the absence of such documentation, iuspirit reserves the right not to accept the order.

3.3 – During and after the purchase process, iuspirit can obtain information regarding the Customer’s credit card, transmitted via secure connections directly to the bank handling the transaction. iuspirit can retain such information only upon the Customer’s explicit request and consent, ensuring that this data is stored according to certified security standards and always displayed in a masked format.

3.4 – Cash on Delivery: For purchases with Cash on Delivery, an additional fee will be applied to the total amount, clearly indicated at the time of payment selection. Payment must be made in cash directly to the courier upon product delivery. Checks will not be accepted by the courier.

3.5 – Bank Transfer: Orders paid by bank transfer will be processed and dispatched only after the payment is credited to iuspirit’s bank account. The necessary details are provided on the website and communicated upon order confirmation. The payment reference must include the order number and the full name of the order holder.

3.6 – Payments via PayPal: For purchases made using PayPal, the total amount will be immediately charged by PayPal upon the completion of the online transaction.

3.7 – During and after the purchase process, iuspirit can obtain information about the Customer’s PayPal account, transmitted through secure connections directly to the bank handling the transaction. iuspirit can retain this information only upon explicit request and consent, ensuring that the data is stored securely and displayed in masked format.

  1. DELIVERY METHODS AND COSTS

4.1 – iuspirit can only accept orders for delivery within Italy, the European Union, San Marino, and Vatican City. Shipments to the Canary Islands and Malta are not available.

4.2 – Sales made on www.iuspirit.com are considered mail-order sales and are not subject to the obligation to issue an invoice, as per Article 22 of Presidential Decree 633/1972, and are exempt from the obligation to issue a receipt, as per Article 2, letter oo), of Presidential Decree 696/1996. The fiscal invoice must be requested explicitly before or at the time of order completion.

4.3 – Delivery costs, if applicable, are borne by the Customer and are specified separately when placing the order. No additional costs are charged beyond the total order amount.

4.4 – iuspirit is not responsible for delays in processing or delivering an order by the courier.

4.5 – Delivery is considered complete at ground level. Upon delivery of the purchased products, the Customer must check:

  • That the number of packages matches what was indicated in the order confirmation and other communications.
  • That the packaging is intact, undamaged, and not altered, especially regarding sealing materials (adhesive tape or straps). Any damage to the packaging, product, or discrepancies in the number of packages must be immediately reported by signing the courier’s delivery slip with a written RESERVATION FOR INSPECTION, specifying the reason (e.g., “damaged packaging,” “crushed package,” “open package”). Once the delivery slip is signed, the Customer cannot contest any exterior defects. Any issues regarding the physical integrity, correctness, or completeness of the received products must be reported within 3 days of delivery.

4.6 – If products are not collected within 10 working days due to repeated unsuccessful delivery attempts at the address provided by the Customer, the order will be returned to iuspirit’s warehouse.

4.7 – In case of product returns, the method of delivery from the Customer to iuspirit depends on the reason for the return:

  • If returning a functioning product due to the Customer’s change of mind, the return shipping costs are borne by the Customer, who may choose a carrier of their preference.
  • If returning a product due to non-conformity or an error by iuspirit, iuspirit will arrange for a pickup by its trusted courier or reimburse standard shipping costs incurred by the Customer.

In any case, the Customer must notify iuspirit in writing within 30 days of the delivery date to exercise the right of withdrawal.

  1. WARRANTIES

All products sold by iuspirit are covered by the manufacturer’s warranty and a 24-month warranty for defects of conformity, as per Legislative Decree 206/05. To benefit from warranty service, the Customer must retain the receipt.

6.1 – The 24-month warranty applies to products showing defects of conformity, provided they are used in accordance with their intended purpose and with the accompanying documentation. This warranty is reserved for private consumers (individuals purchasing goods for non-professional purposes, without providing a VAT number).

ATTENTION: For VAT-registered purchases, the warranty is reduced to 1 year.
ATTENTION: The warranty does not cover micro SD cards included with ordered products.

6.3 – Repair or replacement times depend solely on the policies of the manufacturer and the associated service center. No damages can be claimed from iuspirit for delays in repairs or replacements.

6.4 – In cases where the warranty requires product return, the item must be returned in its original packaging, including all parts (packaging, manuals, cables, etc.). To avoid damage, it is recommended to use secondary packaging for shipment.

RETURN POLICY

Right of Withdrawal

Pursuant to Articles 64 and following of Legislative Decree no. 206/2005, if the customer is a consumer (i.e., a natural person purchasing goods for purposes not related to their professional activity, or who does not indicate a VAT number on the order form), they have the right to withdraw from the purchase contract for any reason within 30 (thirty) days from the receipt of the goods. The customer wishing to exercise the right of withdrawal or reconsideration must do so by sending a written notice to info@iuspirit.com, containing: • A declaration of intent to exercise the right of withdrawal, • Identification of the relevant product, • The order number associated with the package and the customer’s bank account details (bank name, branch, IBAN code – in case of payment made via bank transfer or cash on delivery).

The return of the product must occur without delay and, in any case, the shipment must be made no later than 14 days from the notice of withdrawal. The refund will be processed within 10 (ten) days of the returned goods. iuspirit will refund the price of the items that have been returned, using the same payment method as used by the buyer during the purchase.

The refund will only cover the price of the product as indicated in the order confirmation and receipt. The return shipping costs will be borne by iuspirit only in the case of a product error and/or defect; otherwise, they will be borne by the customer.

The right of withdrawal is subject to the following conditions:

  • The right applies to the purchased product in its entirety; it is not possible to withdraw from the purchase of only part of the product.
  • The return shipping costs are borne by the customer;
  • The shipment, until receipt at our warehouse, is under the full responsibility of the customer;
  • In the event of damage to the product during transport, the customer will be informed (within 5 working days of receipt of the product at our warehouse) to allow them to file a claim with the courier they chose and obtain a refund for the value of the product (if insured); in this case, the product will be made available to the customer for return, and the withdrawal request will be canceled.

A necessary condition for exercising the right of withdrawal is the substantial integrity of the product and its packaging. If the product is not returned in the same condition as received—i.e., in perfect condition, unused, in its original packaging, with the outer packaging and any manuals, with no parts missing—iuspirit will not be able to accept the return, and the product will be returned to the customer at their expense.
